PERSPECTIVE / BROKERAGE FOUNDATIONS

Understand the roles
behind an account.

Different firms may perform different functions in a brokerage relationship. A clear explanation of those functions is more useful than an undefined promise of access.

Start with the relationship

Before considering a brokerage relationship, ask which legal entity would contract with you, what it would do, what it would not do, and which other firms would be involved. Avoid assuming that a familiar brand name identifies every party.

Ask how responsibilities are allocated

Introducing and carrying firms may allocate responsibilities through a carrying agreement. The applicable customer notices and actual agreement matter; branding alone does not explain the arrangement. Read the framework in FINRA Rule 4311.

Ask about execution, not guarantees

Execution involves the handling of orders under changing market conditions. Best execution is a diligence obligation, not a guarantee of a particular result. The relevant framework is described in FINRA Rule 5310.

Review the economics

Ask for the applicable fee schedule, third-party costs and explanations of compensation and conflicts. A short website summary should not be treated as a substitute for the documents governing a specific relationship.
